Man Sentenced to Life Imprisonment for Raping Seven-Year-Old Girl in Hathras, Uttar Pradesh

June 4 2023, Mumbai: In a significant verdict, a special Protection of Children from Sexual Offenses (POCSO) court in Hathras district, Uttar Pradesh, has sentenced a 50-year-old man to life imprisonment for the rape of a seven-year-old girl in 2019. Special judge Chitra Sharma presided over the case and also imposed a fine of Rs 50,000 on the convict, Sanjay Kumar, with the directive to pay the amount to the victim for her rehabilitation.

The incident, which took place on March 13, 2019, shocked the local community and highlighted the urgent need for effective measures to safeguard children from sexual offences. According to the case registered by the victim’s father, the assault occurred when the child was on her way to relieve herself outdoors. Sanjay Kumar, a neighbor known to the family, lured the child to a secluded location, where he allegedly subjected her to a horrific sexual assault. Upon the girl’s cries for help, the accused fled the scene, leaving the traumatised child behind. The young victim managed to find her way back home, and her family rushed her to a nearby hospital for immediate medical attention.

Initially, the FIR (First Information Report) was filed under IPC (Indian Penal Code) section 354, which pertains to assault or criminal force with the intent to outrage a woman’s modesty, along with sections 7/8 of the POCSO Act. However, based on the victim’s statement before a magistrate under CrPC (Code of Criminal Procedure) section 164, the charges were later amended to IPC section 376, which specifically addresses rape, and sections 3/4 of the POCSO Act. The medical examination conducted on the victim confirmed the sexual assault, providing substantial evidence against the accused.

Following the incident, Sanjay Kumar was promptly arrested and has since remained in custody. The conclusion of the trial saw the special judge, Chitra Sharma, hand down a life sentence to the perpetrator, ensuring that he will be held accountable for his heinous crime. In addition to the severe imprisonment term, the court also ordered Sanjay Kumar to pay a fine of Rs 50,000, which will be utilised for the victim’s rehabilitation.

The verdict in this case sends a strong message that the judicial system in Uttar Pradesh is committed to protecting the rights and safety of children. It emphasises the gravity of crimes against minors and reiterates the importance of stringent measures to address and prevent such offences.

The sentence serves as a reminder that sexual crimes against children will not be tolerated, and the perpetrators will face severe consequences for their actions.
