25 US States Challenge Trump's India Tariffs

The case is filed in the U.S. Court of International Trade and the states say the tariffs are illegal and will add costs to American families and businesses.

Why are the Tariffs Being Challenged?

The Trump administration recently imposed new tariffs ranging from 10% to 12.5% on imports of 60 countries to tackle forced labour in global supply chains and so on.

India currently faces a 10% tariff as a result of these measures. The US had earlier proposed a 12.5% tariff on Indian goods, but the rate was reduced after India updated its Foreign Trade Policy to ban imports of products made using forced labour.

But another US investigation is still under way and may result in additional tariffs on Indian exports.

What Do the 25 States Say?

The coalition of states alleges that the tariffs are illegal in fact and will act as an extra tax on consumers and businesses.New York Attorney General Letitia James, Governor Kathy Hochul, and other Democratic leaders have asked the court to strike down the tariffs.

The administration did not follow the legal processes of Section 301 of the Trade Act of 1974 before imposing the new duties, the lawsuit said.

States say Tariffs will increase costs.

The lawsuit argues that if tariffs get passed in the U.S. they will raise the price of imported goods and increase the costs for America’s businesses and consumers.

California Attorney General Rob Bonta said tariffs are essentially taxes that ordinary Americans should not have to pay because of what he called an unlawful economic policy.

The coalition believes the President does not have the authority to impose broad tariffs without following the legal process set out by Congress.

Questions Raised over the Investigation

And the legal challenge also challenges how the tariffs were introduced.

According to the lawsuit:

A few products were found to be linked to forced labour only. Yet tariffs were imposed on goods for a number of countries. Product exemptions weaken the government’s case. The Office of the United States Trade Representative (USTR) failed to properly listen to public comments and submissions from affected countries, it said.The states say that these issues make the tariff policy legally flawed.

India is still subject to a 10 percent tariff under the new US policy.India’s modified trade rules reduced the proposed tariff but the ongoing legal battle in the United States could affect the future of these duties.Another investigation of Indian exports is still pending, so more tariffs might be imposed in the future.
