Mumbai (Maharashtra) [India] December 13 : The RG Kar case, involving the alleged rape and murder of a trainee doctor, took a dramatic turn when the Sealdah court granted bail to former RG Kar principal Sandip Ghosh and ex-Tala police station officer Abhijit Mondal.  

Their release, due to the failure of the central bureau of investigation (CBI) to file a charge sheet within the mandatory 90 days, has left the public questioning whether the victim’s family will see justice.

Bail Raises Questions on Justice for the Victim

The victim’s family, who fought for a second autopsy and a flawless investigation, fears that granting bail to the accused might weaken the focus on delivering justice. They believe that tampering with evidence, as charged against the two, played a significant role in postponing the resolution of the case.

Legal Provisions and Court’s Perspective

According to Section 167 of the Criminal Procedure Code, an accused is entitled to bail if the investigating agency fails to file a charge sheet within 90 days. Legal experts explain that the court followed due process by granting bail, emphasizing that bail does not mean innocence. “The investigation is ongoing, and justice can still prevail if evidence supports the charges,” a legal scholar noted.

CBI’s Challenges in Strengthening the Case

The CBI, now under pressure to ensure a thorough investigation, has promised the court that their investigation is progressing. However, their failure to present sufficient evidence against Ghosh and Mondal within the instructed time has raised concerns about their handling of high-profile cases. The victim’s supporters demand greater responsibility from the investigating agency.

The Path Ahead for Justice

The trial against Sanjay Roy, the prime accused in the rape and murder, continues, with the next hearing scheduled soon. Meanwhile, legal experts highlight that the focus should remain on uncovering the truth. “Justice is a process, and while the bail raises concerns, it is not the final verdict,” a senior lawyer stated.

The RG Kar case serves as a harsh reminder of the challenges in India’s judicial system, where delays and procedural breaks often degrade the pursuit of justice. All eyes remain on the courts and the CBI to provide a fair outcome that honors the memory of the victim.
