Delhi Court issues notice to Sonia Gandhi, Delhi Police on FIR plea over 1980 voter list inclusion
On December 9, 2025, a court in Delhi requested a response from Sonia Gandhi and the police to a petition that challenged the order of the magistrate into the allegation that Gandhi was added to the electoral rolls 3 years prior to receiving citizenship in India in 1983.
New Delhi (India) December 9: On Tuesday, a Delhi Court issued notice to former president of Congress, Sonia Gandhi along with the Delhi police for their response to a 'criminal revision petition' that raised a question of whether the police should file a FIR against her for the offenses of Forgeries and Cheating. The petitioner claimed that Ms. Gandhi's name appeared on the voters list for 1980 prior to her being granted Indian Citizenship in 1983.
Criminal revision petition questions Sonia Gandhi's 1980 voter list entry
Judge Vishal Gogne issued the notices to both Ms. Gandhi and Delhi Police in regard to the criminal revision petition that was filed by Vikas Tripathi, who was challenging the lower court decision that denied his motion for the FIR against Ms. Gandhi for including herself on the electoral rolls of the New Delhi Parliamentary constituency for the 1980 elections.
In issuing notice to Ms. Gandhi and the Delhi Police, Judge Gogne set the matter for January 6 to conduct further proceedings.
Petitioner alleges forgery and cheating in electoral roll inclusion
Mr. Vikas Tripathi filed the revision petition as an advocate. He is also the Vice-president of the Central Delhi Court Bar Association at the Rouse Avenue courts.
Counsel for Advocate Tripathi, Senior Advocate Pavan Narang, stated before the lower Court that Ms. Gandhi was added to the voter list as a voter for the New Delhi Parliamentary Constituency in January 1980 even though she was not an Indian Citizen at that time.
Also, he claimed that the actions of Ms. Gandhi was "some forgery" and thus, "some public authorities" have been "cheated".
Magistrate earlier denied FIR request citing lack of credible evidence
The magistrate denied a request for a police investigation into a complaint filed by the person who made the original complaint about Sonia Gandhi's inclusion in the voter list that occurred three years before she obtained her Indian citizenship. This is because the magistrate found that the original complaint did not establish jurisdiction for the complaint due to a lack of supporting evidence, as required under existing laws.
The magistrate stated that, in view of any criminal activity of cheating or forgery, the accusations made by Tripathi, the petitioner, were not based on credible evidence. Additionally, the only evidence offered by Tripathi was a photocopy of a copy of a photocopy of the current electoral rolls for the years 1980 to 2023.
